Scott A. Silver Partner

Scott A. Silver is a partner of Silver, Garvett & Henkel. He has been practicing law for over 25 years and holds Martindale Hubbell’s highest AV ranking. Scott’s principal areas of practice are business and real estate litigation, business and real estate transactions, and general corporate representation. He has experience in the following fields:

  • class action litigation
  • lender liability
  • judgment collection
  • insurance claims
  • breach of contract litigation
  • construction contract disputes and construction defect claims
  • telecommunications law
  • real estate disputes including both residential and commercial brokerage claims, commercial landlord\tenant disputes, and breaches of real property sales contracts

He acts as a legal advisor to several national and local real estate brokerage firms having offices in South Florida.

Scott has litigated and mediated general and complex commercial cases in the state and federal courts in South Florida both at the trial and appellate court levels. He has also litigated cases in California, the District of Columbia, Georgia, and Texas. He has handled appeals before Florida’s Third District Court of Appeals, in the U.S. Courts of Appeals for the Ninth and Eleventh Circuits, and in the U.S. Supreme Court.

Scott obtained both his Juris Doctor degree (1981) from the University of Florida and his Bachelor of Arts degree from the University of South Florida (1979). After law school, he served as an Assistant Attorney General for the State of Florida, with an emphasis on appellate law. Thereafter he was associated with and then became a partner at the Miami civil litigation firm of Gilbride, Heller & Brown, P.A. In 1989, Scott joined his childhood friend, Fredric Garvett, to found Silver & Garvett, now known as Silver, Garvett & Henkel.

Contemporaneous with his law practice, Scott has been a developer and investor in numerous commercial real estate properties and projects. His signature development is the Palmetto Bay Village Center, an 80-acre office park campus overlooking Biscayne Bay in Miami. This property was the former world headquarters of Burger King Corporation and is the location of Silver, Garvett & Henkel’s offices.

Scott is active in various community and charitable organizations, such as Shake-a-Leg Miami, an organization devoted to the assistance of persons with disabilities and at-risk children. He was the past President of the Deering Estate Foundation and the Founder of the Sobay Festival of the Arts. Scott was an Eagle Scout and supports scouting activities.

He is married and the father of two children.
